Terms of Service

These Terms of Service are an agreement between you and Qbify Technologies Limited ("we", "us"), the company behind Paybob. They govern your use of the Paybob website, your Paybob account and the Paybob software. By buying a licence, installing the software or using our services, you agree to these terms.

1.What Paybob is

Paybob is self-hosted payment automation software. You install and run it on your own server to connect payment gateways, wallets and bank accounts that you own, and to verify and manage the payments your customers make to you.

Paybob is not a bank, payment processor, payment gateway or licensed payment operator. We never receive, hold or transfer your funds or your customers' funds. Payments move directly between your customers and the accounts you control.

2.Licences

When you buy a plan, we grant you a non-exclusive, non-transferable licence to install and use the software for the term of that plan, within the limits of the plan (for example, the number of payment panels and white-label brand domains it includes).

Unless we agree otherwise in writing, you may not:

  • resell, sublicense, rent or redistribute the software or your licence;
  • remove, bypass or disable licence checks, notices or branding that must stay in place;
  • use a single licence beyond the payment panels or white-label brand domains included in your plan;
  • reverse engineer the software, except where the law allows it despite this restriction.

3.Your responsibilities

Because Paybob runs on infrastructure you control, you are responsible for:

  • hosting, securing, updating and backing up your installation and its data;
  • keeping your gateway, wallet and bank credentials safe;
  • complying with the terms of every payment provider you connect, and with the laws that apply to your business, including tax, consumer and data protection laws;
  • using Paybob only for lawful goods and services;
  • keeping your account information accurate and your login details confidential.

4.Acceptable use

You may use Paybob only for lawful purposes. You must not use Paybob, or connect it to any website, app or business, that is illegal or restricted under the laws of the country you operate in, or of the countries where you offer your goods or services. This includes, for example:

  • goods or services that are prohibited, or that require a licence or approval you do not hold;
  • gambling, betting, lotteries or similar activities where they are illegal or unlicensed;
  • fraud, scams, pyramid schemes, money laundering, terrorist financing or evading sanctions;
  • content or products that infringe other people's intellectual property or privacy;
  • anything that breaks the terms of the payment providers you connect.

It is your responsibility to know and follow the laws that apply to your business. The full rules are in our Acceptable Use Policy (paybob.io/acceptable-use), which is part of these terms. If we believe Paybob is being used in breach of it, we may act under the Suspension and termination section below.

5.Law enforcement requests

We may disclose information about you to police, regulators, courts or other authorities when we receive a request we believe is lawful, or when we believe disclosure is necessary to prevent fraud, harm or illegal activity. This may include the details you provided when creating and managing your account, such as your name, email address, phone number, company and billing details, along with your licence records, the domains registered to your licence and your support history.

Where the law allows and it would not put anyone at risk, we may let you know about such a request.

6.Payment providers

Gateways, wallets, banks and other providers you connect are third parties. Your relationship with them, including their fees, availability and decisions about your account, is governed by your agreements with them. We are not responsible for their services, and supported providers may change over time.

7.Fees, renewals and refunds

Licence fees are shown at checkout and billed in advance for each monthly or yearly term. Plans renew for another term unless you cancel before the renewal date. Paybob does not charge a percentage of your transactions; fees charged by your payment providers are separate.

Every licence payment comes with a 30-day money-back guarantee, no questions asked. How refunds, cancellations and renewals work is set out in our Refund & Cancellation Policy (paybob.io/refund-policy), which is part of these terms.

8.Updates and support

While your licence is active you receive software updates and support as described for your plan. We may change, add or remove features, and we will try to give reasonable notice of changes that materially reduce what your plan includes.

9.Intellectual property

Paybob, the software, the website and our brand remain our property. These terms give you a licence to use the software, not ownership of it. Your data, and your customers' data processed by your installation, remain yours.

10.Disclaimer

The software and services are provided "as is" and "as available". To the extent permitted by law, we make no warranties beyond those stated in these terms, including any warranty that the software will be uninterrupted or error-free, or that it will work with every payment provider.

11.Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, lost profits or lost data. Our total liability for any claim relating to Paybob is limited to the fees you paid us in the twelve months before the claim arose.

12.Suspension and termination

You can stop using Paybob at any time.

We may suspend or terminate your licence and your account at any time, with immediate effect and without advance notice, if we believe you have breached these terms (including the Acceptable use section), used Paybob for anything illegal or restricted, failed to pay fees, or if we are required to do so by law or by a lawful request from an authority.

When a licence is suspended or terminated, you must stop using the software under that licence. A licence ended because of a breach of these terms or the Acceptable Use Policy is not covered by the money-back guarantee, except where the law requires otherwise.

13.Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them or your use of Paybob, are governed by the laws of England and Wales.

The courts of England and Wales have jurisdiction over any such dispute. If you use Paybob as a consumer, this doesn't take away any mandatory protections of the law of the country where you live, including any right to bring a claim in your local courts.

Before starting a claim, please contact us first. Most issues can be resolved quickly by talking to us.

14.Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Continuing to use Paybob after a change means you accept the updated terms.
